Parents who hide inappropriate relationships would go to jail

QCOSTARICA — Court approves Frente Amplio bill. The majority of the magistrates of the Full Court consider it necessary to advance a bill that sanctions with prison sentences for parents who hide inappropriate relationships of their children.

This is a reform promoted by the Frente Amplio (FA) party that was already ruled on by the legislative commission on Youth, Childhood and Adolescence and that would make parents or guardians who hide sexual relationships of their children with adults be punished with up to six years in prison.

The bill was analyzed in the Full Court, where the presiding magistrate of the Criminal Chamber, Patricia Solano, said that it is necessary, since penalizing inappropriate relationships has had an effect in recent years.

“We have realized that there is a problem in the prosecution of this type of crime, in the sense that the same parents or guardians encourage, hide, or help when these types of activities occur,” she explained.

Although she indicated, through a report, that the proposal affects the functioning of the Judicial Branch, the majority of the judges voted against the criterion. “When a bill deals with our functioning, if it does not come with the economic resources, the work and the response that we must give to the cases that come in increases,” she said.

Solano maintains that, despite the benefits it presents, the initiative forces the Judicial Branch to carry out new tasks.

However, Patricia Vargas, a judge of the Criminal Cassation Chamber, assured that the inclusion of the new crime does not justify requiring legislators to have a qualified vote, that is, 38 votes are needed for its approval.

Roxana Chacón, a judge of the Second Chamber said that “Far from being able to stop these crimes, they are increasing.”

The initiative, bill 24.193, would also sanction parents or guardians of minors with the loss of custody if they allow, promote or conceal the situation.

“Although parental responsibility already speaks of care and protection, it is considered necessary to establish protection against improper relationships,” explained Frente Amplio legislator, Rocío Alfaro, proponent of the initiative, in March.

The original proposal did not contemplate penal sanctions, but the loss of parental authority over their children, who would be referred to the Patronato Nacional de la Infancia (PANI).
