Holy Thursday and Good Friday are mandatory payment holidays in Costa Rica

QCOSTARICA — As Semana Santa (Easter Week) 2024 approaches it’s important to be aware of your rights as an employee.

Thursday, March 28 and Friday, March 29 are mandatory payment holidays due, but what happens if you decide to work on those days?

The first thing you should know is that no worker is obliged to work on those days unless they agree, no matter what activity they carry out. Nor can you be sanctioned for refusing to work on those dates.

As to payment, companies that pay monthly, biweekly, or weekly, have to pay the full salary, that is, they must pay the days worked during the week, including the holiday Thursday and Friday.

If those days are worked, the additional salary must be double for each day worked. If overtime is worked on these holidays, they must be paid triple pay.

This rule also applies to multinational or global companies, for all their employees in Costa Rica.

Also important to note is that the Thursday and Friday holidays cannot be transferred to another date. That is, an employee cannot be asked to take say the next Monday and Tuesday off, with simple pay, instead of working the Thursday and Friday holidays.

For their part, public sector officials will have collective vacations during Holy Week.

The rules are established in Article 148 of the Código de Trabajo (Labor Code).

Semana Santa or Holy Week is the most sacred week in the liturgical year in Christianity.

In 2024, the week begins on Sunday, March 24th and ends on Saturday, March 30th.
