Costa Rica Says No Nicotine And Cannabis Vapes

QCOSTARICA — The Ministry of Health announced last week new regulations for the use and sale of vapes and electronic cigarettes in Costa Rica that contain synthetic nicotine and those that incorporate liquids with cannabinoids, which are considered health risks, due to the increase in use in the country.

According to data from the Caja Costarricense de Seguro Social (CCSS), there have been 3,170 registered cases of people treated for problems related to vaping between 2021 and 2024. Of the total, 40% of the reported cases are for 2024.

The ban took immediate effect upon its publication and will remain in place until the Ministry issues a technical regulation governing the use and commercialization of these products.

These new regulations are framed in Ley 10,066, which seeks to control electronic nicotine delivery systems and similar devices that use heated tobacco and other technologies.

In addition, Health announced that a bill supported by several ministries of the Executive Branch will be presented, to reform Ley 10,066 to address its legal deficiencies and strengthen its scope.

The ban is expected to have a significant effect on the cannabis industry, especially the vaporizer market, which is still in its early stages of development, changing the business environment for merchants and entrepreneurs in the sector.
